English translation of the Polish original („Regulamin świadczenia usług drogą elektroniczną”). In the event of any discrepancy between the two language versions, the Polish version shall prevail.
§ 1. General provisions
1. These Terms of Provision of Electronic Services (the “Terms”) set out the rules and conditions for the free-of-charge electronic service consisting of making a contact form available by the Service Provider within the website available at stomatologia.medyk-centrum.pl (the “Website”).
2. The Service Provider within the meaning of these Terms is: Prywatne Centrum Medyczne “Medyk-Centrum” Jan Bińczyk with its registered seat at Al. Wolności 34, 42-200 Częstochowa, Poland, Tax ID (NIP): 573-117-80-40, REGON: 150871307, contact e-mail: kontakt@medyk-centrum.pl, phone number: 34 365 46 66 (the “Service Provider”).
3. These Terms have been drawn up pursuant to Article 8(1)(1) of the Act of 18 July 2002 on the Provision of Electronic Services (Journal of Laws of 2020, item 344, as amended) and are made available on the Website free of charge, in a form that allows the User to obtain, reproduce and store them.
4. For the purposes of these Terms:
- “Service Provider” means the entity indicated in § 1(2);
- “Service Recipient” (“User”) means a natural person using the contact form available on the Website;
- “Electronic Service” means the provision of the contact form described in § 2;
- “Contact Form” means the interactive form available on the Website enabling a message to be sent to the Service Provider;
- “GDPR” means Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016.
§ 2. Type and scope of the electronic service provided
1. The Service Provider provides, via the Website, one electronic service within the meaning of the Act on the Provision of Electronic Services: making available a contact form that allows the User to send a message to the Service Provider in order to make contact, obtain information about the healthcare services provided at the clinic, or request that a visit be arranged.
2. Using the contact form and sending a message through it does not constitute the conclusion of an agreement for the provision of a healthcare service, does not constitute a reservation of any specific appointment time, and is not equivalent to its confirmation. The appointment time is arranged separately, through direct return contact between clinic staff and the User (by telephone or e-mail).
3. The Service Provider informs Users that direct electronic appointment booking (e-registration) is not a service provided by the Service Provider within the Website, but is instead carried out through systems operated by third parties, i.e. the znanylekarz.pl platform (operator: ZnanyLekarz sp. z o.o., with its registered seat in Warsaw) and the online booking system available on erejestracja.medyk-centrum.pl/portal. Use of those systems is subject to the terms and conditions made available by their respective operators, with which the User should familiarise themselves separately before using the given system. The Service Provider is not responsible for the operation of those systems.
§ 3. Technical conditions for provision of the electronic service
1. Using the contact form requires the User to meet the following minimum technical conditions:
- access to a device with an internet connection;
- use of an up-to-date web browser with JavaScript and cookies enabled;
- access to an active e-mail account and/or telephone number, to the extent necessary for the Service Provider to respond.
2. The Service Provider notes that using electronic services, including the internet, involves risks typical of such services (e.g. malicious software, phishing) and recommends that Users use up-to-date security software.
3. Users are prohibited from submitting, through the contact form, any content of an unlawful nature, including content that infringes the personal rights of third parties or applicable law.
§ 4. Conclusion and termination of the agreement for the electronic service
1. The agreement for the electronic service consisting of making the contact form available is concluded at the moment the User begins using the form (starts filling in its fields) and is of a one-off nature.
2. The agreement terminates when the message is sent through the form, or when the User stops using the form (e.g. by leaving the Website without sending the message).
3. The service is provided by the Service Provider free of charge.
4. The User may, at any time and without giving a reason, discontinue use of the contact form by closing the Website.
§ 5. Rules for using the contact form
1. The contact form includes fields allowing the User to provide: first and last name, e-mail address and/or telephone number, the content of the message, and, where required, a statement confirming that the User has read the Privacy Policy, in accordance with the current configuration of the form made available on the Website.
2. Completing and sending the contact form is entirely voluntary.
3. The User is required to provide truthful and up-to-date information in the form. Providing false or incomplete information may prevent the Service Provider from responding.
4. A response to a message sent via the contact form is provided subject to the clinic’s organisational capacity, within a reasonable time, to the e-mail address or telephone number indicated by the User.
§ 6. Personal data protection
1. The rules governing the processing of Users’ personal data in connection with the use of the contact form, including information on the data controller, the purposes and legal bases of processing, the data retention period, and the rights available to Users, are set out separately in the Privacy Policy available on the Website at: https://stomatologia.medyk-centrum.pl/polityka-prywatnosci/, which forms an integral supplement to these Terms with respect to the protection of personal data.
2. Use of the contact form may require the User to give consent to the processing of personal data to the extent and on the terms described in the Privacy Policy.
§ 7. Complaints procedure
1. Users are entitled to submit complaints concerning the operation of the electronic service provided within the Website (e.g. malfunctioning of the contact form, technical errors preventing it from being sent).
2. A complaint may be submitted electronically to the e-mail address: kontakt@medyk-centrum.pl or in writing to the registered seat of the Service Provider indicated in § 1(2).
3. A complaint should include at least: contact details of the User (first and last name, e-mail address or postal address) and a brief description of the issue reported.
4. The Service Provider will examine the complaint and respond within 14 days of its receipt, sending the response to the address indicated by the User in the complaint.
§ 8. Final provisions
1. In matters not regulated by these Terms, the relevant provisions of Polish law shall apply, in particular the Act of 18 July 2002 on the Provision of Electronic Services, the Act of 23 April 1964 – Civil Code, and the GDPR.
2. The Service Provider reserves the right to amend these Terms for valid reasons, in particular changes to the scope of its business activity, changes to the functionality of the Website, or changes in the law. Amendments take effect once the updated version of the Terms is published on the Website.
3. The current version of these Terms is always available on the Website in a manner enabling it to be downloaded and stored.
4. These Terms enter into force on 17.08.2026.
